Pivotal Weather Privacy Policy

Pivotal Weather, LLC (“Pivotal Weather,” “we,” “us,” or “our”) operates pivotalweather.com, beta.pivotalweather.com, home.pivotalweather.com, and the websites and online services associated with those domains. We refer to them collectively as the “Site.”

This Privacy Policy explains what personal information we collect, how we use and disclose it, how long we retain it, and the privacy choices available to you.

Pivotal Weather, LLC is the controller of personal information for which we determine the purposes and means of processing. Some service providers and advertising partners may independently determine how and why they process particular information. Their processing may also be governed by their own privacy notices and applicable law.

For purposes of this Privacy Policy, “personal information” means information that identifies, relates to, describes, or could reasonably be linked with an individual or household. It does not include information that has been aggregated or de-identified so that it cannot reasonably be linked with an identifiable individual.

1. Information We Collect

The information we collect depends on how you interact with the Site, whether you create an account or purchase a membership, and which Site features you use.

Account and membership information

We use MemberSpace to provide account registration, authentication, membership administration, subscription management, and access to subscriber-only features.

When you create or use a Pivotal Weather account, MemberSpace may collect and process information such as your first and last name, email address, account login credentials, account creation date, membership plan and status, phone number, optional business name, and account or subscription identifiers. We can access certain account and membership information through MemberSpace’s administrative tools.

We do not directly receive or store your MemberSpace password. MemberSpace processes account information on our behalf and may also process information as described in the MemberSpace Privacy Policy.

Account login credentials may be classified as sensitive personal information under applicable law. They are used to authenticate and secure accounts, administer memberships, prevent fraud and unauthorized access, and provide requested services. We do not use account credentials to infer characteristics about individuals.

We may occasionally export limited member information for account administration, customer communications, marketing to users who selected the optional marketing preference, or related business purposes. These exports are created only as needed, are stored in access-restricted locations under the control of company administrators, and are deleted promptly after their intended use has been completed.

Saved account preferences

Registered users may save favorites and other Site preferences, including preferred model maps, weather models, domains, display settings, units, and similar choices.

These preferences are associated with the user’s account. They are deleted when the associated account is permanently deleted from the membership system, subject to temporary retention in routine backups and retention that may be necessary for security, legal, or dispute-resolution purposes.

Payment and subscription information

Payments are processed by Stripe. Stripe collects and processes payment-card details, billing information, and other information needed to process payments, renewals, refunds, payment disputes, and subscriptions.

We do not directly receive or store complete payment-card numbers or card security codes. We may access limited payment and subscription information through Stripe or MemberSpace, including a customer’s name and email address, billing address, card brand and last four digits, transaction amount, payment status, refund information, subscription status, renewal date, and failed-payment information.

Stripe processes payment and transaction information in accordance with the Stripe Privacy Policy.

Customer support and communications

When you contact us, we may collect your name and email address, the contents of your message, files or attachments you provide, relevant account or subscription information, and other information reasonably necessary to investigate and respond to your request.

Please avoid sending sensitive information that is not necessary for us to address your question or support request.

Marketing communications

During account creation, you may separately and optionally choose to receive Pivotal Weather product updates, news, offers, and promotional emails. Marketing consent is not required to create an account or purchase a membership.

We may periodically export contact information for users who selected the marketing option and provide that information to our email-marketing provider. We and the provider use that information to send the communications for which the user signed up, measure delivery and engagement, and administer unsubscribe requests.

You may unsubscribe from marketing emails at any time by using the unsubscribe link in the message. Even after unsubscribing from marketing, you may continue to receive necessary communications relating to your account, subscription, payments, password, security, or requested services.

Site, browser, device, and usage information

When you visit or use the Site, we and our service providers may automatically collect information concerning your use of the Site. This may include pages viewed, referring pages, links, buttons and Site features used, dates and times of visits, browser type and settings, device type, operating system, screen or display information, Internet Protocol address, network and connection information, cookie, browser or device identifiers, approximate location derived from an IP address, and error, performance, diagnostic, and security information.

On portions of the Site that display advertising, automatically collected information may also include advertising impressions, advertising interactions, advertising identifiers, and related advertising or audience information.

You may browse much of the Site without creating an account, although certain features require registration or a paid membership.

Analytics

We use analytics services, including Google Analytics, on portions of the Site to understand how visitors use the Site, measure traffic and engagement, diagnose performance problems, and improve our products and services.

Analytics providers may process information such as pages viewed, referring pages, Site interactions, browser and device information, cookies or similar identifiers, Internet Protocol addresses, and approximate location derived from an Internet Protocol address.

We do not intentionally send names, email addresses, MemberSpace account identifiers, payment-card information, or other direct account identifiers to our analytics providers. Google processes information associated with Google Analytics in accordance with the Google Privacy Policy and its applicable terms.

Information received from other sources

We may receive information from MemberSpace, Stripe, our analytics and advertising providers, and other service providers when necessary to operate the Site. This may include membership and transaction status, analytics reports, advertising measurements, security or fraud alerts, communication-delivery reports, and other operational information.

2. Approximate Location Information

We do not request access to your device’s GPS and do not intentionally collect precise geolocation information.

Our analytics, advertising, hosting, content-delivery, and security providers may use your Internet Protocol address and related device or network information to estimate an approximate location, such as your city, state, region, or country.

Approximate location information may be used for analytics, Site security, fraud and abuse prevention, advertising, advertising measurement, regional content or settings, and the application of regional privacy controls.

3. How We Use Personal Information

We use personal information to operate, maintain, and improve the Site; provide weather information, maps, models, tools, and other products; create and administer accounts; authenticate users; provide subscriber-only features; save account preferences; and manage subscriptions.

We also use personal information to process payments, renewals, cancellations, refunds, and payment failures; provide customer service and technical support; respond to inquiries and privacy requests; and send account, payment, security, and service-related communications. Where a user has separately chosen to receive them, we may also send marketing or promotional communications.

Personal information may be used to measure Site traffic, engagement, advertising, and performance; diagnose technical problems; maintain service availability; prevent fraud, misuse, and unauthorized access; protect the security and integrity of the Site; display and measure advertising; and apply consent or privacy preferences.

We may also use personal information to maintain business, transaction, tax, and accounting records; comply with legal obligations; establish, exercise, or defend legal claims; enforce our agreements and policies; and protect Pivotal Weather, our users, and others.

4. Cookies, Similar Technologies, and Consent Management

We and our providers use cookies, pixels, local storage, browser identifiers, and similar technologies to operate the Site and understand how it is used.

Some of these technologies are necessary to support account login, authentication, subscription access, security, fraud prevention, network management, service availability, and the storage of privacy or consent preferences. Functional technologies may remember choices such as saved units, display preferences, favorite maps and models, and other Site settings.

Analytics technologies help us understand how visitors use the Site, measure traffic and performance, identify technical problems, and improve the Site. Advertising technologies may be used to display advertisements, personalize advertisements, limit how often advertisements appear, measure advertising performance, create or use advertising audiences, and support targeted or cross-context behavioral advertising.

Raptive provides the consent-management and privacy-choice interface used on the advertising-supported portions of the Site. Depending on a visitor’s location and applicable law, the interface may allow the visitor to accept, reject, or customize nonessential analytics and advertising technologies. Visitors may reopen the available privacy settings and change their choices later.

We configure applicable analytics and advertising technologies to respond to the consent and privacy choices communicated through the consent-management interface. The specific choices shown and the consequences of a selection may vary based on the visitor’s location, applicable law, and the technologies being used.

You may also block or delete cookies through your browser settings. Blocking cookies or local storage may prevent certain Site features, including account login, saved preferences, and privacy settings, from working correctly.

5. Advertising

Raptive advertising is used on pivotalweather.com and beta.pivotalweather.com. Raptive advertising is not used on home.pivotalweather.com.

The following disclosure is required by Raptive for portions of the Site on which Raptive advertising is used: CMI Marketing, Inc., d/b/a Raptive (“Raptive”) is a service provider of this Site for the purposes of placing advertising on the Site, and Raptive will collect and use certain data for advertising purposes. Raptive and participating advertising partners may use cookies and similar technologies to collect or process cookie and device identifiers, Internet Protocol addresses, browser and device information, pages viewed, Site interactions, referring pages, advertising impressions and interactions, approximate location, and advertising interests or audience segments.

When a visitor rejects advertising consent or exercises an applicable advertising opt-out, Raptive restricts personalized advertising and related consent-dependent processing in accordance with the visitor’s choice and applicable law. Contextual or non-personalized advertisements may still be displayed.

All Pivotal Weather membership plans are ad-free while the member is properly signed in. The Raptive advertising script does not load after the Site recognizes a properly signed-in member.

Raptive’s Advertising Privacy Statement governs information processed by Raptive for its advertising services.

6. How We Disclose Personal Information

We may disclose personal information to providers that help us operate the Site. These include MemberSpace for membership and account administration; Stripe for payment processing; analytics and advertising providers; and providers of website hosting, infrastructure, content delivery, security, data storage, email delivery, marketing, customer support, fraud prevention, and professional services.

Some providers process personal information only on our instructions. Other providers may independently determine the purposes and means of particular processing, including for payment-network compliance, fraud prevention, analytics, or advertising. Their handling of information is governed by their agreements with us, their own privacy notices where applicable, and applicable law.

We may disclose personal information when reasonably necessary to comply with law or legal process; respond to lawful government requests; investigate fraud, misuse, or security incidents; enforce our agreements; protect the rights, property, or safety of Pivotal Weather, our users, or others; or establish, exercise, or defend legal claims.

Information may also be disclosed in connection with an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our company or assets. We may otherwise disclose information at your direction or with your consent.

We may use and disclose aggregated or de-identified information that cannot reasonably be linked to a specific individual.

7. Sale, Sharing, Targeted Advertising, and Online Tracking

Raptive and participating advertising partners may collect or receive cookie and device identifiers, Internet or browsing activity, approximate location, advertising interactions, and advertising-related inferences through advertising technologies used on pivotalweather.com and beta.pivotalweather.com.

Under some U.S. state privacy laws, these activities may be considered a “sale,” “sharing,” or processing for targeted advertising, even when no money is paid for an individual customer or membership record.

Raptive and participating advertising partners may collect information about a visitor’s activity over time and across websites or online services for advertising, audience creation, and measurement purposes, subject to applicable consent and opt-out rights.

A “Do Not Sell or Share My Personal Information” link is available on pivotalweather.com and beta.pivotalweather.com through the Raptive privacy interface. Visitors may use that link to exercise applicable choices concerning sale, sharing, or targeted advertising. Browser-based choices may need to be enabled separately on each browser or device used.

Global Privacy Control

Where required by applicable law, supported Global Privacy Control signals are treated as requests to opt out of sale or sharing and applicable targeted-advertising processing.

Do Not Track

Some browsers transmit a “Do Not Track,” or DNT, signal. Because there is no universally accepted standard for interpreting DNT signals, the Site does not currently respond to the DNT signal.

This does not affect our treatment of Global Privacy Control or another legally recognized opt-out preference signal. DNT and Global Privacy Control are separate browser signals and may be treated differently under applicable law.

8. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy. Retention periods may vary based on the nature of the information, the reason it was collected, security considerations, and applicable legal, tax, accounting, or regulatory requirements.

Account and membership information is retained while an account remains active and for a limited period afterward when necessary for account administration, legal compliance, accounting, security, fraud prevention, enforcement, or dispute resolution.

Saved account preferences are deleted when the associated account is permanently deleted, subject to temporary retention in routine backups.

Payment, transaction, tax, and accounting records maintained by us or accessible to us through Stripe, MemberSpace, or our accounting systems may be retained for up to seven years.

Customer-support correspondence is generally retained for approximately three years. Particular communications may be retained longer when relevant to an unresolved dispute, security incident, or legal obligation.

Server and security logs under our control are generally retained for approximately two weeks unless they are needed for a longer period to investigate a security incident, prevent fraud or abuse, resolve a technical problem, or comply with law. Hosting, content-delivery, and security providers may apply different retention periods to logs maintained in their own systems.

Analytics information is retained in accordance with our configured provider settings and for as long as reasonably necessary for measurement, reporting, security, and service improvement. Aggregated or de-identified analytics reports may remain available for longer periods.

Marketing preferences and suppression records are retained for as long as reasonably necessary to document consent, administer communications, and honor unsubscribe or opt-out requests.

Locally exported member information is retained only for the purpose for which the export was created and is deleted promptly after that purpose has been completed.

Our service providers may retain certain information for longer periods when required by their own legal, regulatory, tax, accounting, security, payment-network, or fraud-prevention obligations.

Deleted information may remain temporarily in routine backups until those backups are overwritten or deleted. We may also retain information that has been aggregated or de-identified so that it can no longer reasonably be linked to an individual.

9. Your Choices and Privacy Rights

You may review or update certain account information through your account settings.

You may request deletion of your account and personal information by emailing support@pivotalweather.com. Deleting an account will terminate access to subscriber-only features and may require or result in cancellation of an active subscription.

We will take reasonable steps to delete information under our control and direct applicable processors to delete information when required. We may retain information needed to comply with legal obligations, maintain tax and accounting records, prevent fraud, protect security, resolve disputes, enforce agreements, or continue honoring unsubscribe and privacy preferences. Service providers may also retain limited information under their own legal obligations and retention policies.

You may unsubscribe from promotional emails at any time by using the unsubscribe link in the message. Unsubscribing from marketing does not prevent us from sending necessary account, payment, subscription, password, security, or service communications. Account deletion and marketing unsubscription are separate actions, and you may need to use the marketing unsubscribe link even after requesting account deletion.

Depending on where you live and which laws apply, you may have the right to request access to personal information, correct inaccurate information, request deletion, receive a portable copy of certain information, restrict or object to certain processing, withdraw consent, opt out of sale, sharing, or targeted advertising, appeal a denied privacy request, and exercise applicable rights without unlawful discrimination.

To submit a privacy request, email support@pivotalweather.com. We will respond within the period required by applicable law.

For access, correction, deletion, or portability requests, we may take reasonable steps to verify your identity. Verification may include confirming access to the email address associated with your account or requesting information reasonably necessary to match you with the relevant records.

We do not require account creation or identity verification merely to exercise a browser-based opt-out of sale, sharing, or targeted advertising when verification is not required by law.

Where permitted by law, an authorized agent may submit a request on your behalf. We may request evidence that the agent is authorized to act for you and may ask you to verify your identity directly where permitted.

If applicable law gives you the right to appeal our decision regarding a privacy request, you may appeal by emailing support@pivotalweather.com with the subject line “Privacy Request Appeal.” Please identify the original request and explain why you believe the decision should be reconsidered.

10. Supplemental U.S. State Privacy Disclosures

This section supplements the remainder of this Privacy Policy for residents of U.S. states with applicable comprehensive privacy laws. The statutory categories described here are broad legal classifications, and we do not necessarily collect every type of information included within each category.

During the preceding 12 months, we and our providers may have collected identifiers, including names, email addresses, Internet Protocol addresses, account identifiers, and cookie or device identifiers; customer or account records, including contact information, account information, billing addresses, and limited payment information; commercial information, including membership plans, subscriptions, transactions, renewals, cancellations, refunds, and payment status; Internet or electronic network activity, including pages viewed, referring pages, Site interactions, timestamps, browser information, and advertising interactions; approximate geolocation derived from an Internet Protocol address; limited professional information, such as an optional business name; advertising-related inferences, interests, or audience segments; and sensitive personal information consisting of account login credentials processed through MemberSpace.

We obtain this information directly from users; automatically from browsers, devices, cookies, and Site interactions; and from MemberSpace, Stripe, analytics providers, Raptive, hosting and security providers, email providers, and other service providers.

We collect and use these categories for the account, subscription, customer-service, analytics, security, advertising, legal, and operational purposes described elsewhere in this Privacy Policy. We may disclose applicable categories to service providers and contractors for business purposes such as account administration, payment processing, hosting, security, analytics, communications, customer support, fraud prevention, and professional services.

For purposes of applicable state privacy laws, we may have sold or shared cookie or device identifiers, Internet or electronic network activity, approximate location, advertising interactions, and advertising-related inferences with Raptive and participating advertising partners for targeted or cross-context behavioral advertising.

We do not sell or share MemberSpace account login credentials for targeted advertising. Account credentials are used and disclosed only for authentication, account administration, security, fraud prevention, and other purposes permitted by applicable law. We do not use sensitive personal information to infer characteristics about individuals.

We do not use personal information to make decisions that produce legal or similarly significant effects concerning an individual.

We do not knowingly sell or share the personal information of children under 16 or knowingly use their personal information for targeted advertising.

The availability and scope of particular privacy rights depend on the law that applies to Pivotal Weather and the person submitting the request.

11. EEA, UK, and Swiss Users

If you are located in the European Economic Area, United Kingdom, or Switzerland, Pivotal Weather, LLC is the controller of personal information for the processing described in this section, except where another organization acts as an independent controller.

We process information as necessary to create and administer accounts, provide memberships and subscriber services, authenticate users, process transactions, deliver requested products, and provide requested support. These activities are generally necessary to perform a contract with you or take requested steps before entering into a contract.

We may rely on legitimate interests to operate and maintain the Site, secure the Site, prevent fraud and abuse, respond to inquiries, diagnose technical problems, maintain appropriate business records, improve services where consent is not legally required, and protect our legal rights. When relying on legitimate interests, we consider the effects of the processing on the rights and interests of affected individuals.

Where legally required, we rely on consent for nonessential analytics technologies, personalized advertising, advertising cookies and similar technologies, and optional marketing communications. You may withdraw consent through the available privacy controls or by contacting us. Withdrawal does not affect processing that occurred before consent was withdrawn.

We may also process information when necessary to comply with tax, accounting, regulatory, court, law-enforcement, or other legal requirements.

Subject to applicable conditions and exceptions, you may have the right to access your personal information, correct inaccurate information, request deletion, restrict processing, object to processing based on legitimate interests, object to direct marketing, receive certain information in a portable format, and withdraw consent. You may object to direct marketing at any time.

You may also file a complaint with the data-protection authority responsible for your place of residence or work or the location of an alleged infringement.

Personal information may be processed in the United States and other countries where Pivotal Weather and its service providers operate. Where required by applicable law, international transfers may rely on an adequacy decision, contractual protections, participation by a provider in an applicable data privacy framework, or another legally recognized transfer mechanism.

You may contact us for additional information about safeguards applicable to your information.

12. Information Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

These safeguards include encrypted connections, access controls, authentication controls, restricted administrative access, security monitoring, and the use of established membership and payment providers.

Member passwords are handled by MemberSpace, and complete payment-card numbers are handled by Stripe rather than stored directly by Pivotal Weather.

No method of electronic transmission or storage is completely secure. We therefore cannot guarantee absolute security.

If a security incident affects personal information, we will provide notice to affected individuals and relevant authorities where required by law.

13. Children’s Privacy

The Site and its account services are not intended for children under 16. We do not knowingly collect personal information directly from children under 16.

We do not knowingly sell or share the personal information of children under 16 or knowingly use their personal information for targeted advertising.

If you believe that a child under 16 has provided personal information to us, contact support@pivotalweather.com. We will investigate the report and take appropriate action, including deletion where required.

14. Third-Party Links and Services

The Site may contain links to websites, products, or services operated by third parties.

We do not control and are not responsible for the privacy, security, or information practices of third-party websites or services. A link from the Site does not mean that Pivotal Weather endorses or controls the third party’s privacy practices.

We encourage you to review the applicable privacy notice before providing information to or using a third-party service.

15. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our services, technology, providers, legal obligations, or information practices.

When we update the Privacy Policy, we will revise the “Last updated” date at the beginning of the Policy.

If a change materially affects how we use personal information, we will provide additional notice and obtain consent where required by law.
